Terms of Service
1. Acceptance of these terms
By using Bargin (the website at findbargin.com, our mobile app, and any related services — collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. What Bargin is
Bargin is a price comparison and lead-generation service. We operate in two distinct ways:
- US retailer comparison: We aggregate publicly available product and pricing information from US-based retailers (Amazon, Best Buy, Walmart, and others) and display it in one place so you can compare prices in USD.
- Local merchant directory: Verified Jamaican businesses pay a subscription fee to be listed alongside US retailers as an alternative purchase option. We provide their contact details (WhatsApp, store location) so you can transact directly with them.
We do not sell products directly. We do not handle shipping, returns, warranties, payment processing, or product fulfillment — those are handled entirely by the retailer or local merchant you choose to engage with. Bargin's role ends at the moment you click through to a retailer or message a local merchant.
3. Eligibility
You must be at least 13 years old to use Bargin. If you are between 13 and 18, you may only use the Service with the permission of a parent or legal guardian. To purchase a Bargin Pro subscription, you must be of legal age to enter into a binding contract in your jurisdiction (18 in most places).
4. Bargin Pro subscriptions
Bargin Pro is an optional paid subscription that unlocks additional features:
- Monthly plan: $4.99 USD per month, billed monthly
- Yearly plan: $39.99 USD per year, billed annually (saves 33%)
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. Payment is processed by Paddle, our Merchant of Record, who handles billing, taxes, and refunds on our behalf. We do not store your card details. All prices are in US Dollars (USD). Applicable sales tax, VAT, or GST will be calculated and added at checkout by Paddle based on your location.
5. Cancellation and refunds
You may cancel your subscription at any time through your account dashboard or by emailing billing@findbargin.com. Cancellations take effect at the end of your current billing period — you will retain access to Pro features until that date.
Refund policy:
- For monthly subscriptions, we do not offer prorated refunds for partial months.
- For yearly subscriptions, you may request a full refund within 14 days of the initial charge. After 14 days, refunds are at our sole discretion.
- Refund requests for technical issues (e.g. the Service was unavailable for an extended period) will be reviewed case-by-case.
Prices on Bargin are pulled from third-party retailers in near-real-time, but they can change at any moment without notice. The price displayed on Bargin may differ from the final price at checkout on the retailer's website due to taxes, shipping, regional pricing, stock availability, or sudden promotions ending. Always confirm the final price on the retailer's site before completing a purchase. We are not responsible for any difference between the price shown on Bargin and the price you pay at the retailer.
6. Freight forwarder estimates & international shipping
Bargin provides estimated landed-cost calculations for shipments to Jamaica (and other Caribbean destinations as we expand). These estimates include freight forwarder rates, customs duties, GCT, and government fees based on publicly available information at the time of calculation.
All freight forwarder rate estimates on Bargin are estimates only and may differ from the actual amount your chosen forwarder charges you. Actual costs depend on factors we cannot predict, including:
- Actual package weight and dimensions (we estimate based on category averages)
- The forwarder's current published rates (which can change without notice)
- Membership status, promotions, or volume discounts you may qualify for
- Customs Department assessments and valuations
- Exchange rate fluctuations between USD and JMD (we display a recent rate but it is not real-time)
- Special handling fees for oversized, fragile, or hazardous items
- Additional broker fees for items above JMD $50,000 in value
7. Restricted & prohibited items
Bargin provides a Jamaica Restricted Items reference at findbargin.com/restricted-items and may display in-product warnings when a listed item appears to match a restricted category. This information is provided as a courtesy based on Jamaica Customs Agency rules and other regulatory bodies. It is updated periodically but may not reflect the most recent changes.
The restricted-items list is not exhaustive and may not reflect current law. Bargin does not warrant the accuracy or completeness of this list. You are solely responsible for confirming whether any item you intend to import is legal, requires a permit, faces elevated duty, or is otherwise restricted under Jamaica law (or the law of your jurisdiction).
Before ordering high-value or potentially restricted items, contact the Jamaica Customs Agency or the relevant regulatory authority directly. Bargin is not liable for any seized packages, customs fines, legal consequences, or other losses arising from imports — flagged or unflagged on our platform.
8. Local Merchant Marketplace (Lead-Generation Service)
Bargin operates a lead-generation directory of verified Jamaican businesses ("Local Merchants") who pay us a subscription fee to be listed alongside US retailers. This section applies to both buyers who use the directory and merchants who list with us.
8.1 For buyers — how the directory works
When a Local Merchant appears in a product comparison, you may click "WhatsApp" or "Directions" to contact them. At that moment, you leave Bargin and engage directly with the merchant. Bargin does not facilitate, broker, process, witness, or guarantee any transaction that follows.
Specifically, we do not:
- Process payment between you and the local merchant
- Hold funds in escrow or provide buyer protection
- Guarantee that listed prices will be honored at the time you contact the merchant
- Guarantee product authenticity, condition, quality, or fitness for purpose
- Handle deliveries, pickups, returns, refunds, or exchanges
- Resolve disputes between buyers and local merchants
- Verify that a merchant has the product in stock at the time of your inquiry
8.2 What "Verified" means
The "✓ Verified" badge indicates that Bargin has reviewed the merchant's claimed business information and confirmed basic details such as their business address and contact information. Verification is a basic trust signal — not an endorsement, warranty, or guarantee of quality. A verified merchant may still operate poorly, fail to honor listed prices, sell counterfeit goods, or otherwise underperform. Verification is not a substitute for your own due diligence.
8.3 For merchants — listing terms
If you sign up to list your business on Bargin, the following apply:
- Eligibility: You must operate a legitimate business legally registered or operating in Jamaica (or another supported Caribbean country as we expand). You must have authority to represent the business and accept these Terms on its behalf.
- Accurate representation: All business information you provide (name, address, contact details, business hours, product descriptions, prices, photos) must be truthful and current. You agree to update outdated information promptly.
- Price honoring: You agree to honor your listed prices for any buyer who contacts you through Bargin, except where stock has genuinely changed since your last update. Repeatedly listing artificially low prices to attract leads then quoting higher prices is "bait-and-switch" and grounds for termination.
- Responsiveness: You agree to respond to buyer inquiries through your provided WhatsApp number within a reasonable timeframe (typically 24 business hours) and in good faith.
- Legal compliance: You will comply with all applicable Jamaican law, including the Consumer Protection Act, fair-trade rules, advertising standards, and tax obligations (including GCT registration if your annual revenue exceeds JMD $10 million). Bargin is not responsible for your tax compliance.
- Prohibited listings: You will not list counterfeit goods, stolen goods, items restricted from import to Jamaica (see our restricted items list), items requiring permits you do not hold, or anything illegal under Jamaican law.
- License to display: You grant Bargin a worldwide, royalty-free, non-exclusive license to display your business name, logo, photos, descriptions, address, contact details, and prices on the Service for as long as your listing is active. This license terminates when your listing is removed.
- Suspension & termination: Bargin may suspend or remove your listing at any time, with or without notice, for: violation of these Terms, repeated buyer complaints, failure to pay subscription fees, fraudulent activity, or any reason at our sole discretion. We will pro-rate refunds for unused prepaid time where reasonably possible, but reserve the right to withhold refunds in cases of fraud or material breach.
- Subscription fees: Monthly merchant subscription fees are billed in advance. By default, fees are non-refundable for partial months. You may cancel at any time and your listing will remain active until the end of the current billing period.
- No commission, no transaction processing: Bargin does not take a percentage of your sales. We never see or touch your transactions. You set your own prices, payment terms, and delivery arrangements directly with buyers.
- Indemnification: You agree to indemnify and hold Bargin harmless from any claim, dispute, damage, or expense arising from your listings, your conduct toward buyers, products you sell, or your breach of these Terms.
8.4 Dispute resolution between buyers & merchants
If a buyer and a Local Merchant have a dispute, they should resolve it directly. Bargin will not mediate, arbitrate, or be drawn into private commercial disputes between users of the directory. However, we encourage buyers to report problematic merchants to merchants@findbargin.com — repeated, substantiated complaints will result in merchant suspension or removal from the platform. Reporting a merchant does not entitle you to a refund or compensation from Bargin.
9. Retailer links
Bargin does not participate in affiliate programs. When you click a retailer link on Bargin, you are taken directly to that retailer's website — Bargin does not earn a commission on the purchase. Our rankings, deal scores, and recommendations are based only on the genuinely best price we found. Local Merchants who are Pro subscribers may receive ⭐ Featured placement above non-featured listings; this placement is clearly labeled and only applies within the Local Merchants section, not to overall product rankings.
10. Acceptable use
You agree to use Bargin only for lawful purposes. You will not:
- Scrape, crawl, or use automated tools to extract data from Bargin without our written permission
- Attempt to interfere with, compromise, or disrupt the Service
- Resell, rent, or repurpose data obtained from Bargin
- Use Bargin to violate any law, third-party right, or these Terms
- Create multiple accounts to abuse free trials or referral programs
- Use the Service in any way that could harm other users or our reputation
We reserve the right to suspend or terminate accounts that violate these rules, without notice and without refund.
11. Intellectual property
The Bargin name, logo, design, and all original content on the Service (excluding product information from retailers) are the property of Bargin and protected by copyright and trademark laws. You may not copy, modify, reproduce, or create derivative works from any part of the Service without our explicit permission.
Product names, images, and trademarks shown on Bargin belong to their respective retailers and manufacturers. We display them under fair use for the purpose of price comparison.
12. User & merchant submitted content
Consumer users: The Service does not currently accept consumer-generated public content (such as reviews or comments). Your wishlist is stored locally in your browser. If you create a Bargin account and sign in, your wishlist is also stored in our database so it can sync across your devices. See our Privacy Policy for details on how wishlist data is handled.
Local Merchants: Merchants who sign up for a listing submit content including business name, address, contact information, product descriptions, prices, photos, and operating hours. By submitting this content, the merchant warrants that they own or have the right to use it, that it is truthful and current, and that it does not infringe any third party's rights. Bargin reserves the right to edit, format, reject, or remove any submitted merchant content at its sole discretion. See Section 8 for full merchant terms.
If we add other content features in the future (such as buyer reviews of local merchants), additional terms will apply.
13. Third-party services
Bargin relies on third-party services to operate, including but not limited to:
- Paddle — payments and Merchant of Record for both consumer (Bargin Pro) and merchant (Local Merchant Marketplace) subscriptions
- Vercel — website hosting and serverless functions
- SerpAPI — Google Shopping price data aggregation
- Amazon Product Advertising API — Amazon product enrichment
- Google Maps Places API — verification of Local Merchant business locations
- WhatsApp — buyer-to-merchant messaging via click-to-chat links
Your use of any third-party service (a retailer's website, a Local Merchant's WhatsApp, Google Maps, etc.) is governed by that third party's own terms and privacy policy — not by ours. Bargin is not responsible for the actions, policies, content, or availability of any third party we link to or integrate with.
14. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the Service will be uninterrupted, secure, or error-free
- Any warranty about the accuracy, completeness, or reliability of prices, product information, deal scores, price history, freight forwarder estimates, Jamaica landed-cost calculations, or restricted-items information shown on the Service
- Any warranty about products you purchase from third-party retailers via links on the Service
- Any warranty about products, services, conduct, or representations of Local Merchants listed in our directory — including but not limited to product authenticity, quality, fitness for purpose, accurate pricing, delivery, or after-sale support
- Any warranty about the verification status of Local Merchants — the "✓ Verified" badge confirms only that the business exists at the claimed address, not that the merchant is trustworthy, competent, or solvent
15. Limitation of liability
To the fullest extent permitted by law, Bargin and its founders, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $50 USD.
16. Indemnification
You agree to indemnify and hold harmless Bargin and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from: your violation of these Terms; your misuse of the Service; your violation of any third-party right; or — if you are a buyer — any dispute, transaction, or loss arising from your dealings with a Local Merchant; or — if you are a Local Merchant — any claim by a buyer, government agency, or third party arising from your listings, products, services, or conduct on or through the Service.
17. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason — including violation of these Terms. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will continue to apply.
You may stop using the Service at any time. To delete any data we hold about you, see our Privacy Policy.
18. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, for significant changes, notify Pro subscribers by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
19. Governing law and disputes
These Terms, and any dispute arising from them or your use of the Service, are governed by the laws of Jamaica, without regard to conflict-of-laws principles.
19.1 Informal resolution first. Before filing any claim, you agree to first contact us at hello@findbargin.com and attempt to resolve the dispute informally. We will try to resolve the dispute informally within 30 days of receiving notice. Most disagreements can be resolved this way.
19.2 Class action waiver. Any dispute not resolved informally will be brought only on an individual basis. You and Bargin each waive any right to bring or participate in a class action, collective action, or representative proceeding against the other. If this waiver is found unenforceable as to a particular claim, only that claim is affected — every other claim, and the rest of this Section 19, remains in full effect.
19.3 Venue. Any dispute not resolved informally will be subject to the exclusive jurisdiction of the courts of Jamaica.
20. Severability
If any part of these Terms is found to be unenforceable, the remaining parts will continue in full effect. The unenforceable part will be modified only to the minimum extent necessary to make it enforceable.
21. Copyright & takedown requests
Bargin displays product names, descriptions, and images sourced from third-party retailers, manufacturers, and search providers for the purpose of price comparison. Product images are generally hotlinked from the originating retailer or manufacturer — we do not copy or store them on our own servers. All product names, images, logos, and trademarks remain the property of their respective owners and are shown under fair use for comparison purposes.
If you are a rights holder (or an authorized agent) and believe any content shown on Bargin infringes your copyright or other rights, we will promptly remove or disable access to it. Send a takedown notice to copyright@findbargin.com that includes: (a) identification of the work or right you claim is infringed; (b) the specific URL(s) or product(s) on Bargin where it appears; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and (e) your physical or electronic signature. We aim to respond to valid requests within 5 business days.
